50% and 75% Savings With USPTO Fees

Micro Entity Criteria (75% USPTO Fee Savings)
Small Entity – The applicant must certify as a small entity.
Four Or Less Patents – An applicant must certify not to be named as an inventor on more than four previously filed patent applications (counting only utility, design, continuation, divisional, reissue, and national stage from an international application).
Income Less Than $153,051 – Certify that no applicant had a gross income exceeding three times the median household (September 17, 2013, $153,051).
Assignee Micro Entity – Has not assigned, granted, conveyed, or licensed to another owner with an income above the gross income limit.
No Third Parties – Third-party filers are not eligible for the micro entity fee.

Small Entity Criteria (50% USPTO Fee Savings)
Person or Small Business – A person, a small business (no more than 500 persons), or most non-profits and university.
Assignee Small Entity – Has not assigned, granted, conveyed, or licensed to a non-small entity.
Maintained Throughout – Maintain status through maintenance fees once qualified.

Large Entity Criteria
All USPTO Actions – Any patent filer not small or micro entity qualified.
Some With All Entities – Some standard fees apply to small or micro entities.

“Patent Pending” Status Established
Authorization to mark an invention as “Patent Pending” or other similar notice is granted upon any formal patent application filing with the USPTO.

The purpose of stating a patent is pending can be at least two fold:
Give Notice – is to give notice to deter infringement and warn that penalties will be due if the invention is practiced without permission. If there is infringement, the next important step is to send a copy of the patent to give formal notice.

Show Value – There is some marketing clout available from stating “Patent Pending” by notifying the public that the invention is novel and a patent is pending.
